Terms and Conditions for the Sale of Dosimeter Products

1. Introduction

These terms and conditions ("Terms") govern the sale of dosimeter products ("Products") by Air by CCSquared Inc ("Seller") to the customer ("Buyer"). By purchasing our Products, Buyer agrees to be bound by these Terms.

2. Product Description

The dosimeter products are designed to measure employee exposure to vapors in the workplace, including but not limited to isoflurane, sevoflurane, ethylene oxide and glutaraldehyde. Detailed specifications of the Products are provided in the product description and our wbesite.

3. Order and Acceptance

3.1 All orders are subject to acceptance by Seller.
3.2 Buyer must provide accurate and complete information when placing an order and submitting the dosimeters for analysis.
3.3 Seller reserves the right to refuse any order at its sole discretion.

4. Pricing and Payment

4.1 Prices for the Products are as specified in the order confirmation.
4.2 We accept credit card payments through Stripe.  Customer will be contacted in case of failed card and asked to update the card information.

5. Delivery

5.1 Delivery dates are estimates and are not guaranteed.
5.2 Seller is not liable for any delays in delivery.

6. Inspection and Acceptance of Products

6.1 Buyer must inspect the Products upon receipt (both of the dosimeter and the final report).
6.2 Any claims for shortages or defects must be made in writing within [10] days of receipt.
6.3 If Buyer fails to notify Seller within this period, the Products are deemed accepted.

7. Limitation of Liability

8.1 Seller's liability for any claim arising out of or relating to the Products is limited to the purchase price of the Products.
8.2 Seller is not liable for any indirect, incidental, or consequential damages.

8. Compliance with Laws

Buyer agrees to comply with all applicable laws and regulations regarding the purchase and use of the Products.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Florida without regard to its conflict of laws principles.

10. Dispute Resolution

Any disputes arising out of or relating to these Terms or the sale of the Products shall be resolved through good faith negotiation.
 

11. Entire Agreement

These Terms constitute the entire agreement between Seller and Buyer regarding the sale of the Products and supersede all prior agreements and understandings.

12. Amendments

Seller reserves the right to amend these Terms at any time. Any amendments will be effective upon posting on Seller's website or upon notice to Buyer.

Service Description

We help you measure your exposure to anesthetic gases by offering badge-style dosimeters that have been specifically validated for the measurement of isoflurane and sevoflurane. We analyze these using laboratory methods that are new-and-improved versions of the classic OSHA 103/106 method but using a modern GC-MS (mass spectrometer) instrument that identifies each substance with very high certainty by measuring mass ions that are specific to each anesthetic gas.  This analysis method allows us to rule out the possibility of an interfering substance (isopropanol, ethyl chloride, methylene chloride), ensuring that your results are correct every time.

Health Effects of Occupational Exposure to Isoflurane

Acute exposure to isoflurane is well-known among users to cause severe headaches, loss of balance, and fatigue (see brochure from Cal OSHA). Chronic exposure is reportedly linked to deleterious effects on the central nervous system, as well as dose-dependent effects on the cardiopulmonary system as well effects on fertility such as miscarriages and birth defects (see publication from Loc Pokhrel for risk assessment). Consequently, CAL OSHA has set the legal exposure limit to isoflurane to 2 PPM.

How much is too much?

In the US, the recommended exposure limit for halogenated anesthetics agents is commonly accepted to be 2 PPM (the legal limit in CA).  The original recommendation was made in 1977 by NIOSH, long before the introduction of the halogenated agents used today (isoflurane and sevoflurane), and applies to halothane, chloroform, trichloroethylene, enflurane, methoxyflurane, and fluroxene. NIOSH has announced an effort to determine RELs for these new substances, although the results of these studies have not yet been reported.  Until these limits are established, “the responsible approach to worker health and safety remains to minimize exposure to (these) waste gases to the lowest practical level" (see recommendations from the American College of Veterinary Anesthesia and Analgesia, downloadable doc). Thus, any detectible exposure is potentially harmful (especially if chronic) and needs to be monitored and controlled.  Exposure limits have been established in other countries too.
